The Cautious Jealous Virtue – Annette C. Baier – Harvard University Press

Like David Hume, whose work on justice she engages here, Annette C. Baier is a consummate essayist: her spirited, witty prose captures nuances and telling examples in order to elucidate important philosophical ideas.

Baier is also one of Hume’s most sensitive and insightful readers. In The Cautious Jealous Virtue, she deepens our understanding of Hume by examining what he meant by “justice.” In Baier’s account, Hume always understood justice to be closely linked to self-interest (hence his description of it in An Enquiry Concerning the Principles of Morals as “the cautious jealous virtue”), but his understanding of the virtue expanded over time, as evidenced by later works, including his History of England.

Along with justice, Baier investigates the role of the natural virtue of equity (which Hume always understood to constrain justice) in Hume’s thought, arguing that Hume’s view of equity can serve to balance his account of the artificial virtue of justice. The Cautious Jealous Virtue is an illuminating meditation that will interest not only Hume scholars but also those interested in the issues of justice and in ethics more generally.

The Idea of Justice – Amartya Sen – Harvard University Press

Social justice: an ideal, forever beyond our grasp; or one of many practical possibilities? More than a matter of intellectual discourse, the idea of justice plays a real role in how—and how well—people live. And in this book the distinguished scholar Amartya Sen offers a powerful critique of the theory of social justice that, in its grip on social and political thinking, has long left practical realities far behind.

The transcendental theory of justice, the subject of Sen’s analysis, flourished in the Enlightenment and has proponents among some of the most distinguished philosophers of our day; it is concerned with identifying perfectly just social arrangements, defining the nature of the perfectly just society. The approach Sen favors, on the other hand, focuses on the comparative judgments of what is “more” or “less” just, and on the comparative merits of the different societies that actually emerge from certain institutions and social interactions.

At the heart of Sen’s argument is a respect for reasoned differences in our understanding of what a “just society” really is. People of different persuasions—for example, utilitarians, economic egalitarians, labor right theorists, no­-nonsense libertarians—might each reasonably see a clear and straightforward resolution to questions of justice; and yet, these clear and straightforward resolutions would be completely different. In light of this, Sen argues for a comparative perspective on justice that can guide us in the choice between alternatives that we inevitably face.

The Second-Person Standpoint – Stephen Darwall – Harvard University Press

Why should we avoid doing moral wrong? The inability of philosophy to answer this question in a compelling manner—along with the moral skepticism and ethical confusion that ensue—result, Stephen Darwall argues, from our failure to appreciate the essentially interpersonal character of moral obligation. After showing how attempts to vindicate morality have tended to change the subject—falling back on nonmoral values or practical, first-person considerations—Darwall elaborates the interpersonal nature of moral obligations: their inherent link to our responsibilities to one another as members of the moral community.

As Darwall defines it, the concept of moral obligation has an irreducibly second-person aspect; it presupposes our authority to make claims and demands on one another. And so too do many other central notions, including those of rights, the dignity of and respect for persons, and the very concept of person itself. The result is nothing less than a fundamental reorientation of moral theory that enables it at last to account for morality’s supreme authority—an account that Darwall carries from the realm of theory to the practical world of second-person attitudes, emotions, and actions.

Constitutional Theocracy – Ran Hirschl – Harvard University Press

At the intersection of two sweeping global trends—the rise of popular support for principles of theocratic governance and the spread of constitutionalism and judicial review—a new legal order has emerged: constitutional theocracy. It enshrines religion and its interlocutors as “a” or “the” source of legislation, and at the same time adheres to core ideals and practices of modern constitutionalism. A unique hybrid of apparently conflicting worldviews, values, and interests, constitutional theocracies thus offer an ideal setting—a “living laboratory” as it were—for studying constitutional law as a form of politics by other means. In this book, Ran Hirschl undertakes a rigorous comparative analysis of religion-and-state jurisprudence from dozens of countries worldwide to explore the evolving role of constitutional law and courts in a non-secularist world.

Counterintuitively, Hirschl argues that the constitutional enshrinement of religion is a rational, prudent strategy that allows opponents of theocratic governance to talk the religious talk without walking most of what they regard as theocracy’s unappealing, costly walk. Many of the jurisdictional, enforcement, and cooptation advantages that gave religious legal regimes an edge in the pre-modern era, are now aiding the modern state and its laws in its effort to contain religion. The “constitutional” in a constitutional theocracy thus fulfills the same restricting function it carries out in a constitutional democracy: it brings theocratic governance under check and assigns to constitutional law and courts the task of a bulwark against the threat of radical religion.

Unmaking the Public University – Christopher Newfield – Harvard University Press

An essential American dream—equal access to higher education—was becoming a reality with the GI Bill and civil rights movements after World War II. But this vital American promise has been broken. Christopher Newfield argues that the financial and political crises of public universities are not the result of economic downturns or of ultimately valuable restructuring, but of a conservative campaign to end public education’s democratizing influence on American society. Unmaking the Public University is the story of how conservatives have maligned and restructured public universities, deceiving the public to serve their own ends. It is a deep and revealing analysis that is long overdue.

Newfield carefully describes how this campaign operated, using extensive research into public university archives. He launches the story with the expansive vision of an equitable and creative America that emerged from the post-war boom in college access, and traces the gradual emergence of the anti-egalitarian “corporate university,” practices that ranged from racial policies to research budgeting. Newfield shows that the culture wars have actually been an economic war that a conservative coalition in business, government, and academia have waged on that economically necessary but often independent group, the college-educated middle class. Newfield’s research exposes the crucial fact that the culture wars have functioned as a kind of neutron bomb, one that pulverizes the social and culture claims of college grads while leaving their technical expertise untouched. Unmaking the Public University incisively sets the record straight, describing a forty-year economic war waged on the college-educated public, and awakening us to a vision of social development shared by scientists and humanists alike.

The Heart of William James – William James, Robert D. Richardson – Harvard University Press

On the one hundredth anniversary of the death of William James, Robert Richardson, author of the magisterial William James: In the Maelstrom of American Modernism, assembles a wide-ranging selection of essays and writings that reveal the evolution of James’s thought over time, especially as it was continually being shaped by the converging influences of psychology, philosophy, and religion throughout his life.

Proceeding chronologically, the volume begins with “What Is an Emotion,” James’s early, notable, and still controversial argument that many of our emotions follow from (rather than cause) physical or physiological reactions. The book concludes with “The Moral Equivalent of War,” one of the greatest anti-war pieces ever written, perhaps even more relevant now than when it was first published. Justice for Hedgehogs – Ronald Dworkin – Harvard University Press

The fox knows many things, the Greeks said, but the hedgehog knows one big thing. In his most comprehensive work Ronald Dworkin argues that value in all its forms is one big thing: that what truth is, life means, morality requires, and justice demands are different aspects of the same large question. He develops original theories on a great variety of issues very rarely considered in the same book: moral skepticism, literary, artistic, and historical interpretation, free will, ancient moral theory, being good and living well, liberty, equality, and law among many other topics. What we think about any one of these must stand up, eventually, to any argument we find compelling about the rest.

Skepticism in all its forms—philosophical, cynical, or post-modern—threatens that unity. The Galilean revolution once made the theological world of value safe for science. But the new republic gradually became a new empire: the modern philosophers inflated the methods of physics into a totalitarian theory of everything. They invaded and occupied all the honorifics—reality, truth, fact, ground, meaning, knowledge, and being—and dictated the terms on which other bodies of thought might aspire to them, and skepticism has been the inevitable result. We need a new revolution. We must make the world of science safe for value.

“I have always loved the Holy Tongue” – Anthony Grafton, Joanna Weinberg – Harvard University Press

Fusing high scholarship with high drama, Anthony Grafton and Joanna Weinberg uncover a secret and extraordinary aspect of a legendary Renaissance scholar’s already celebrated achievement. The French Protestant Isaac Casaubon (1559–1614) is known to us through his pedantic namesake in George Eliot’s Middlemarch. But in this book, the real Casaubon emerges as a genuine literary hero, an intrepid explorer in the world of books. With a flair for storytelling reminiscent of Umberto Eco, Grafton and Weinberg follow Casaubon as he unearths the lost continent of Hebrew learning—and adds this ancient lore to the well-known Renaissance revival of Latin and Greek.

The mystery begins with Mark Pattison’s nineteenth-century biography of Casaubon. Here we encounter the Protestant Casaubon embroiled in intellectual quarrels with the Italian and Catholic orator Cesare Baronio. Setting out to understand the nature of this imbroglio, Grafton and Weinberg discover Casaubon’s knowledge of Hebrew. Close reading and sedulous inquiry were Casaubon’s tools in recapturing the lost learning of the ancients—and these are the tools that serve Grafton and Weinberg as they pore through pre-1600 books in Hebrew, and through Casaubon’s own manuscript notebooks. Their search takes them from Oxford to Cambridge, from Dublin to Cambridge, Massachusetts, as they reveal how the scholar discovered the learning of the Hebrews—and at what cost.

Prefaces to Shakespeare – Tony Tanner – Harvard University Press

When Tony Tanner died in 1998, the world lost a critic who was as sensitive a reader of Jane Austen as he was of Thomas Pynchon, and who wrote with a warmth and clarity that belied his fluency in literary theory.

In the final ten years of his life Tanner tackled the largest project any critic in English can take on—writing a preface to each of Shakespeare’s plays. This collection serves as a comprehensive introduction for the general reader, the greatest and perhaps the last in the line of great introductions to Shakespeare written by such luminaries as Samuel Johnson and Samuel Taylor Coleridge. Tanner brings Shakespeare to life, explicating everything from big-picture issues such as the implications of shifts in Elizabethan culture to close readings of Shakespeare’s deployment of complex words in his plays.

Although these prefaces are written for a general audience, there is much value for the scholar as well. Tanner introduces some of the most significant recent and historical scholarship on Shakespeare to show the reader how certain critics frame large issues in a useful way. This scholarly generosity permits Johnson, Hazlitt, Emerson, Thoreau, Ruskin, Pater, and many others to enter into conversation. The Independent said of the project, “All of Tanner’s life and education had prepared him for this task and the results are magnificent—both accessible and erudite.”

Minerva’s Owl – Jeffrey Abramson – Harvard University Press

Informal in tone yet serious in content, this book serves as a lively and accessible guide for readers discovering the tradition of political thought that dates back to Socrates and Plato. Because the arguments of the great philosophers are nearly eternal, even those long schooled on politics will find that this book calls on recurring questions about morality and power, justice and war, the risk of democracy, the necessity for evil, the perils of tolerance, and the meaning of happiness. Jeffrey Abramson argues politics with the classic writers and draws the reader into a spirited conversation with contemporary examples that illustrate the enduring nature of political dilemmas. As the discussions deepen, the voices of Abramson’s own teachers, and of the students he has taught, enter into the mix, and the book becomes a tribute not just to the great philosophers but also to the special bond between teacher and student.

As Hegel famously noted, referring to the Roman goddess Minerva, her owl brought back wisdom only at dusk, when it was too late to shine light on actual politics. Abramson reminds us that there are real political problems to confront, and in a book filled with grace and passion, he captures just how exciting serious learning can be.
